TERMS AND CONDITIONS

TERMS OF SALE: A DOWN PAYMENT DEPOSIT OF $5,000 PER PROPERTY IS DUE IMMEDIATELY UPON THE CONCLUSION OF THE BIDDING WITH THE BALANCE DUE AT CLOSING IN 30 DAYS. IN THE EVENT THAT THE TWO PROPERTIES ARE SOLD IN A COMBINED FORM, A DOWN PAYMENT DEPOSIT OF $10,000 WILL BE DUE. THE DEPOSITS WILL BE HELD IN A TRUST ACCOUNT UNTIL THE CLOSING DATE. AT THE CLOSING, THE BUYER WILL PAY THE BALANCE OF THE PURCHASE PRICE AND TAKE TITLE AND POSSESSION OF THE PROPERTY. THE SELLER AND THE PURCHASER(S) MUST SIGN THE PURCHASE AGREEMENT. PURCHASER(S) WILL RECEIVE A FREE AND CLEAR TITLE WITH ALL REAL ESTATE TAXES PRORATED TO THE DATE OF THE FINAL SETTLEMENT.

THE PROPERTIES ARE BEING OFFERED BY OPEN BIDDING. COURT ORDER REQUIRES A MINIMUM BID OF 2/3 OF THE APPRAISED VALUE FOR EACH PROPERTY:

Brick Home - A MINIMUM BID OF $44,000 IS REQUIRED
White Home - A MINIMUM BID OF $30,000 IS REQUIRED

THE BRICK HOME WILL BE OFFERED FIRST. AT THE CONCLUSION OF THE BIDDING, THE HIGH BID WILL BE HELD. THEN THE WHITE HOME WILL BE OFFERED. AT THE CONCLUSION OF THE BIDDING, THE HIGH BID WILL BE HELD. THE AUCTIONEER WILL THEN OFFER BOTH PROPERTIES COMBINED. A BID OF $1,000 ABOVE THE SUM OF THE TWO HELD BIDS WILL BE NECESSARY TO OPEN THE BIDDING. IF THIS BID IS MADE, ADDITIONAL BIDS ON THE COMBINED PROPERTIES WILL BE TAKEN UNTIL A HIGH BIDDER IS DECLARED AND THE COMBINED PROPERTIES ARE SOLD. IF THERE IS NO INTEREST IN THE PROPERTIES TOGETHER, THE TWO HELD BIDS WILL BE CONSIDERED FINAL.

THE PROPERTIES ARE SUBJECT TO THE TERMS AND CONDITIONS OF THIS AUCTION. PURCHASERS ARE RESPONSIBLE FOR OBTAINING THEIR OWN FINANCING. THIS SALE HAS NO CONTINGENCIES AND IS NOT CONTINGENT ON THE PURCHASERS OBTAINING FINANCING. ALL INSPECTIONS, INCLUDING LEAD-BASED PAINT, MUST BE CONDUCTED PRIOR TO AUCTION DATE. APPRAISAL OR ANY OTHER INSPECTION FEES ARE AT THE BUYER'S EXPENSE.

IF ANY DISPUTE ARISES BETWEEN OR AMONG BIDDERS, THE DECISION OF THE AUCTIONEER SHALL BE FINAL AND ABSOLUTE. THE AUCTIONEER, UPON DISCLOSURE, RESERVES THE RIGHT TO BID ON BEHALF OF LEGITIMATE ABSENTEE BIDDERS.
